We recently cancelled coverage for our client/customer due to expiration or delinquent payments. The client has since renewed or made good on payments. What do we need to provide to CLC on behalf of our client/customer to reinstate their license?

As you may be aware, licensees are contractually required to maintain current product liability insurance. To remedy the problem, please provide CLC with an updated insurance certificate and additonal insured endorsement or reinstatement notice for your client. Licensees have 15 days to reestablish liability insurance coverage following notification to CLC that the policy is cancelled. If the licensee fails to provide documentation that they have resecured the necessary liability insurance within 15 days, they will be in breach of their License Agreement and subject to cancellation.

The updated insurance certificate and additional insured endorsement or reinstatement notice should be sent to the licensee's CLC Licensing Coordinator, of if you are not sure who the licensee's coordinator is, you can address the correspondence to "Insurance" and submit it to CLC via facsimile (770.955.4491).

What do we include in the "Insured" section of the insurance certificate?

The licensee’s name must appear under "Insured" (if you are an insurance agent or provider, your client is the licensee). It may be listed as an "a.k.a." or "d.b.a.".

How long should we insure our client (the licensee)?

Although the licensee (your client) is free to secure insurance for whatever term they desire as long as they have continuous coverage throughout the term of their license agreement, CLC recommends that insurance be secured for a term of at least one year. When CLC receives correct insurance certificates and endorsements, the end of term for coverage is entered into our systems. Our systems notify our staff to send insurance renewal packages out to the licensees accordingly. Licensees that fail to keep their insurance up to date are subject to cancellation.

Will CLC and or the institutions accept an insurance binder?

No. A binder is not sufficient to meet CLC’s insurance requirements. A certificate and an Additional Insured Endorsement must be provided to meet CLC's insurance requirements.

What language does CLC require within the additional insured endorsement?

The language of the additional insured endorsement must read exactly as follows:

Name of Person or Organization

The Collegiate Licensing Company ("CLC"), all institutions represented by CLC for which insured is licensed, and their respective officers, agents and employees.

Why do we need to work with CLC regarding insurance if our client is licensed with an institution?

As the exclusive licensing representative for these collegiate properties, CLC grants a license to manufacturers to produce and distribute merchandise incorporating the trademarks of CLC Institutions upon approval by that Institution. Each company requesting a license must obtain the proper product liability insurance coverage and, if a license is granted, maintain that coverage during the term of the License Agreement. All CLC Licensees are required to obtain a minimum of $1 million in general insurance, including product liability and other coverage. Insurance is required to help protect the licensee, the institutions, and CLC in the case of any claims of damages or defects related to the collegiate licensed merchandise as well as other liability claims. All licensees, regardless of products or potential risk, are required to obtain this insurance, and some licensees with higher risk products will be required to obtain additional coverage beyond the $1 million level (CLC will notify you if this is the case).

Must all licensees have the required liability insurance?

All CLC Licensees are required to obtain a minimum of $1 million in general insurance, including product liability and other coverage. Insurance is required to help protect the licensee, the institutions, and CLC in the case of any claims of damages or defects related to the collegiate licensed merchandise as well as other liability claims. Who should we talk to at CLC regarding our insurance questions?

All current and prospective licensees are provided with a document entitled "Product Liability Insurance Requirements" during the application process, at renewal, or when the term of their insurance coverage ends. Attached to the document is another document meant for use by licensee insurance agents or providers entitled "Insurance Agent Instructions - CLC Liability Insurance". Detailed information regarding CLC's insurance requirements is provided in these documents. Applicants and insurance agents may also visit the FAQ section of www.clc.com and search the Insurance Agent FAQs for answers to any other questions. Licensees may review CLC insurane requirements within the "License Management- Insurance" section of MyiCLC. If licensees still have questions/problems after reviewing these information sources, they should contact their assigned CLC Licensing Coordinator via email. The email should be entitled as follows:

Please include your company name of record with CLC, your contact name, email, and phone number, and indicate if you are an applicant or an existing licensee going through renewal. Also, please indicate the nature of the problem or type out your question in the body of the email.
